King Digital Pvt. Ltd. provides digital communication, technology, marketing, development, AI, hosting, cloud, content, and related business solutions.
Services may include Bulk SMS, WhatsApp Business/API, RCS, IVR/Voice, Cloud Telephony, AI Agents, AI Chatbots, Voice AI, website development, SEO, Google Ads/PPC, social media services, ORM, hosting, video production, voice-over, podcast production, and related integrations.
The exact scope, deliverables, timelines, pricing, and specifications of a service will be based on the package, quotation, proposal, order, or written agreement accepted by the customer.
2Customer Responsibilities
Customers must provide accurate information, content, credentials, approvals, databases, brand assets, and other materials required to deliver the agreed services.
Customers are responsible for ensuring that information, content, recipient data, images, videos, trademarks, and other materials supplied to King Digital Pvt. Ltd. can be legally used for the intended purpose.
3Payments
Applicable service fees must be paid according to the agreed quotation, invoice, package, or payment schedule. Services may be activated only after the required payment is successfully received and verified.
Advertising spend, telecom charges, API usage, software subscriptions, hosting, domains, third-party platform fees, taxes, transaction charges, and other external costs may be charged separately unless specifically included in writing.
4Cancellations & Refunds
All purchases are final unless otherwise agreed in writing. Once a service, campaign, subscription, communication credit, development project, hosting resource, AI solution, or other digital service has been activated or work has commenced, payments are generally non-refundable and non-transferable.
King Digital Pvt. Ltd. may suspend or terminate services for non-payment, misuse, policy violations, unlawful activity, spam, fraud, abuse, or security-related concerns.
5Bulk SMS, WhatsApp & RCS
Customers using Bulk SMS, OTP, WhatsApp Business/API, RCS, or related communication services must comply with applicable telecom regulations, platform policies, consent requirements, and service-provider guidelines. Customers are responsible for their message content, recipient databases, templates, campaigns, and required opt-ins.
Unsolicited messaging, spam, misleading communication, fraud, or unauthorized use is prohibited. Message delivery may depend on operators, networks, recipient devices, platform approval, technical availability, and other third-party factors and therefore cannot be guaranteed in every case.
6IVR, Voice & Cloud Telephony
IVR, Voice, Cloud Telephony, virtual number, and related services must not be used for harassment, fraud, unauthorized calls, spam, misleading communication, or any unlawful activity.
Call quality, connectivity, availability, and routing may depend on telecom operators, networks, internet connectivity, and third-party infrastructure beyond the direct control of King Digital Pvt. Ltd.
7AI Services
AI services may include AI Agents, AI Chatbots, Voice AI, Knowledge Base/RAG solutions, Prompt Studio, automated workflows, and related integrations. AI-generated results may depend on customer-provided information, prompts, databases, APIs, models, and third-party technologies.
King Digital Pvt. Ltd. does not guarantee that every AI-generated response will be completely accurate or error-free. Customers should review important outputs before relying on or publishing them.
8Website Design & Development
Website projects are delivered according to the mutually agreed scope. Customers must provide required content, media, credentials, approvals, product/service information, and feedback on time.
Additional features, pages, integrations, revisions, redesigns, or functionality outside the agreed scope may involve additional charges and timelines. Delays caused by pending customer content, approvals, credentials, feedback, or third-party services may affect the project completion date.
9Digital Marketing & Advertising
Digital marketing services may include SEO, Social Media Marketing/Management, Google Ads/PPC, ORM, content marketing, and lead generation.
Results may vary due to competition, advertising budget, algorithms, market conditions, website performance, customer offers, audience behaviour, and third-party platform changes. Unless specifically agreed in writing, King Digital Pvt. Ltd. does not guarantee fixed rankings, leads, sales, followers, reach, revenue, or ROI.
10Content, Video & Podcast Services
Customers must ensure that scripts, photographs, videos, music, logos, trademarks, recordings, and other assets supplied for creative, video, voice-over, or podcast services are legally permitted for use.
Additional shoots, reshoots, revisions, edits, or deliverables beyond the agreed scope may be charged separately.
11Hosting, Cloud & Server Usage
Hosting, cloud, server, API, and technical resources must not be used for illegal, malicious, abusive, or unauthorized purposes.
Activities that compromise security, overload systems, interfere with other users, distribute malware, perform unauthorized scanning, or create abnormal resource usage may result in immediate restriction or suspension.
12Anti-Spam & Acceptable Use
King Digital Pvt. Ltd. follows a zero-tolerance approach toward unauthorized spam. Customers must not use purchased, illegally obtained, or improperly collected contact databases through our communication services.
Services must not be used for fraudulent campaigns, phishing, malicious content, unauthorized system access, malware distribution, harassment, or activities that violate applicable laws, regulations, or third-party platform policies.
13Third-Party Platforms & Services
Certain services depend on third-party providers such as telecom operators, advertising platforms, social networks, hosting companies, domain registrars, software providers, APIs, AI providers, and payment services.
King Digital Pvt. Ltd. is not responsible for third-party downtime, policy changes, account restrictions, rejected advertisements or templates, delivery failures, pricing changes, or other actions outside our reasonable control.
14Intellectual Property
Customers retain responsibility for intellectual property they provide to King Digital Pvt. Ltd. Unless otherwise agreed in writing, King Digital Pvt. Ltd. retains ownership of its pre-existing tools, systems, processes, frameworks, know-how, reusable code, and proprietary technology.
Rights relating to final project deliverables will be governed by the applicable proposal, quotation, invoice, or written agreement and may be subject to full payment of all outstanding amounts.
15Confidentiality & Account Access
Both parties should take reasonable steps to protect confidential business information exchanged for the purpose of delivering services.
Customers are responsible for keeping account credentials secure and for promptly informing King Digital Pvt. Ltd. if unauthorized access or misuse is suspected.
16Uptime & Availability
King Digital Pvt. Ltd. makes reasonable efforts to maintain service availability but does not guarantee 100% uninterrupted uptime. Maintenance, updates, hardware failure, internet or telecom outages, third-party downtime, cyber incidents, regulatory actions, or circumstances beyond our reasonable control may affect availability.
17Backup & Data
Customers are responsible for maintaining independent backups of important websites, files, databases, credentials, media, and other business information.
Where backup facilities are provided, King Digital Pvt. Ltd. does not guarantee that every backup will always be complete, current, or recoverable.
18Suspension & Termination
King Digital Pvt. Ltd. may restrict, suspend, or terminate a service where there is non-payment, misuse, spam, fraud, abuse or harassment, unlawful activity, security risk, policy violation, or activity affecting systems or other users.
Where termination results from serious misuse or policy violations, refunds may not be provided and appropriate legal action may be taken where necessary.
19Limitation of Liability
King Digital Pvt. Ltd. will not be responsible for indirect, incidental, consequential, or business losses arising from service interruptions, third-party platforms, customer misuse, inaccurate customer information, technical failures, or circumstances beyond our reasonable control.
Customers are responsible for evaluating whether a service is suitable for their business requirements before relying upon it.
20Pricing & Service Changes
King Digital Pvt. Ltd. may revise service pricing, packages, features, resources, or specifications at any time, subject to the terms of any active written agreement.
Changes in third-party costs, telecom rates, APIs, AI services, hosting, software, advertising platforms, or regulatory requirements may result in corresponding service or pricing changes.
21Renewals
Customers are responsible for renewing domains, hosting, servers, communication packages, APIs, software subscriptions, and other recurring services before expiry.
King Digital Pvt. Ltd. is not responsible for interruption or expiry resulting from delayed payment or failure to renew within the required timeline.
22Changes to Terms
King Digital Pvt. Ltd. reserves the right to revise, add, remove, or modify these Terms & Conditions and related policies at any time. Revised terms will apply once published on our website unless otherwise stated.
Customers are advised to review our Terms & Conditions, Privacy Policy, Refund Policy, and other applicable policies before placing an order or continuing to use our services.
